The Tribunal appointed to investigate the conduct of suspended Environment and Land Court judge Mohammed Noor Kullow has concluded that he has no case to answer.
Judge Kullow was suspended from office in March last year following a recommendation from the Judicial Service Commission.
The Judge faced accusations of several issues, including delays in delivering rulings and judgments, failing to provide reasons for these delays, neglecting to respond to the Chief Justice’s correspondence, retaining a court file that hindered a party’s ability to lodge an appeal against a ruling, delivering rulings and judgments without issuing notices, and demonstrating incompetence.
In a report submitted to President William Ruto at the conclusion of its investigation, the Tribunal, chaired by Justice Patrick Omwenga Kiage, stated that after considering “all evidence tendered and the applicable law, the Tribunal finds that the thirteen allegations have not been established to the required extent.”
In light of its findings of no wrongdoing, the Tribunal urged President William Ruto to allow the judge to resume his duties in the corridors of justice.
“Your Excellency, having found as above concerning the allegations against the Hon. Judge, the Tribunal unanimously recommends that the Hon. Mr. Justice Mohammed Noor Kullow, Judge of the Environment and Land Court, ought to be reinstated to the office of judge of the Environment and Land Court,” stated the Tribunal.
The Tribunal was composed of Justice Patrick Omwenga Kiage (Chairperson), Lady Justice Margaret Njoki Mwangi, Lady Justice Cecilia Wathaiya Githua, Jinaro Kipkemoi Kibet, Wanjiru Mwariri, Rukia Abdinasir Mohamed, and Charles Mulila, a former Board Member at Kenya Broadcasting Corporation.
