Lawyer Elisha Ongoya, who framed Kibwezi Member of Parliament Mwengi Mutuse during the trial of Rigathi Gachagua in the Senate, he has turned off Kisumu senator Tom Ojienda.
Addressing the court on the impeachment trial of Gachagua on Tuesday, October 22, Ongoya criticized Ojienda although not directly while calling for discipline.
It all started when Ongoya asked Gachagua's team of lawyers to be given time to submit an official application, saying it could not be submitted earlier as disclosures were made during the proceedings.
He added by asking the judge to set a schedule for when the petition should be submitted and decide the return date for submitting the petition.
This request prompted Ojienda to stand up and ask if Ongoya was asking for an adjournment.
He further asked if Gachagua's lawyers had a plan to leave the court as they did in the Senate.
“My Lord, is that an adjournment of the case? Is Ongoya asking for an adjournment of the case…? If so, they usually leave the court, as they did in the Senate. Let them say if they are asking for an adjournment of the case,” Ojienda said.
In his response, Ongoya pointed out that law professor Ojienda was wrongly involved during the deliberations of the case to oust Gachagua.
“Is that statement 'like what the Senate did' appropriate in this court, My Lord? You know we have discipline in front of the court. If we have a law professor, if he gets involved in a bad way in front of the court, there is a problem. I ask you to guide that statement to be removed first and then we can move forward, “ Ongoya replied.
Ongoya's statement caused the entire court to burst into laughter as Ojienda tried to clarify his point.
“I have no problem withdrawing that statement. The point is that it is a failed request to postpone the case. Why should he not go to the point?” Ojienda said.
