According to the acting IG, Judge Mugambi also erred in convicting him of contempt of court, but sent representatives to his chambers.
“That the learned Judge erred in law by saying that the Appellant cannot be represented by the agent who recognizes him or his lawyers to explain why the previous orders of habeas corpus were not observed.
“That by seeing the Acting Inspector General of Police in contempt of court without an official request for contempt, the learned Judge erred in law by giving bad results in matters that were not acceptable,” read part of his appeal.
Why the Bumula MP said Masengeli is being unfairly targeted
Elsewhere, Bumula Member of Parliament Jack Wanami Wamboka expressed his disapproval after the Acting Inspector General of Police was sentenced to six months in prison.
The Member of Parliament referred to Masengeli's problems in court as being politically motivated.
In a strong speech during a rally in Bumula on Friday, September 13, Wamboka claimed Masengeli was being held accountable for actions that occurred before his leadership.
The MP explained that former inspector general Japhet Koome was in charge when the series of killings and kidnappings took place.
