The Independent Electoral and Boundaries Commission (IEBC) is ready to auction the properties of several politicians who lost the election.
Why do Kenyan politicians owe millions to IEBC?
According to records filed before the Public Accounts Committee, as reported by the Daily Nation, the IEBC was awarded KSh 400 million in fees related to unsuccessful petitions filed against the 2013 and 2017 election results.
The politicians who lost in the election cases in court ran for various seats including governorship, parliament and Senate.
People Daily reported that the money was KSh 4.3 million from the lower courts in 2013, KSh 99 million given to the agency by the Supreme Court in response to petitions submitted following the 2013 election, and another KSh 32 million given by the lower courts in connection with the vote of 2017 comments.
Chief Executive Officer IEBC Marjan Hussein attributes the organization's failure to get the money a decade later to the lengthy process of implementing court orders.
“We have spent a lot of effort in recovering the amount, but it is not giving the expected results. That is why we went through the auction method on the advice of the attorney general,” Hussein said.
Who are the politicians whose assets will be auctioned?
The former commissioner of the state Hassan Noor Hassan, who is owed KSh 5 million by the commission for a petition against the former governor of Mandera and the current senator Ali Roba, leads the list of politicians who are owed by the commission.
Others are former Member of Parliament Walter Nyambati (KSh 5 million) and Leny Kivuti (KSh 4.5 million), who lost his bid to oust Martin Wambora as governor of Embu.
Farah Maalim owes IEBC KSh 3 million after losing his application against the former Member of Parliament Garissa In Aden Duale.
Also in the list are Josephat Nanok, Elizabeth Ongoro (KSh 1.5 million), the late Jakoyo Midiwo (KSh 1.5 million), and the late Member of Parliament for Likoni Masudi Mwahima (KSh 1 million).
How much did the lawyers who represented IEBC get?
In a separate story, Auditor General Nancy Gathungu revealed that IEBC paid KSh 502.3 million to 28 law firms that represented them in the Supreme Court presidential election case.
The lead lawyer and the assistant received a huge reward of KSh 158.96 million, but the auditor did not mention their names.
In the 2022/2023 financial year, IEBC spent KSh 713.8 million on statutory payments but failed to provide supporting receipts.
