Nairobi MCA released on Ksh100K cash bail after pleading not guilty to 8 charges

The Member of County Assembly (MCA) for Huruma Ward, Nairobi County, Peter Owera Oluoch, on Tuesday, March 4, 2025, pleaded not guilty to eight charges, including providing false information to the Ethics and Anti-Corruption Commission (EACC).

The MCA was also accused of forging three different signatures and three official stamps from different advocates on different dates in 2027, purporting them to be genuine among other charges.

Lawyer Willy Momanyi, representing the Directorate of Public Prosecution (DPP), told the court that they were not opposed to the accused being released on bond.

Deposit passport

Appearing before Chief Principal Magistrate Isabella Barasa of the Anti-Corruption at the Milimani Law Courts, Momanyi also proposed that the accused should deposit his passport in court.

However, lawyer Titus Ochichi, representing the accused, opposed the DPP’s request of his client to deposit his passport in court.

“We are opposed to the DPP proposal for my client to deposit his passport,” lawyer Ochichi told court.

Lawyer Ochichi further stated that the MCA is not a flight risk and his place of abode is well known.

He urged the court to give his client a reasonable cash bail, adding that the accused has been and will be cooperating with the officers carrying out the investigations.

“We want to plead with the court for very lenient terms of release because our client is ready to attend the court when needed,” lawyer Ochichi told the court.

Charges against MCA

According to the charge sheet, on December 20, 2012, MCA Oluoch is said to have provided false information to EACC stating that he holds a diploma from Kenya Polytechnic contrary to section 46 (1) (d) as read with section 46 (2) of the Leadership and Integrity Act No. 12 of 2012.

On the second count, Oluoch is accused that on May 26, 2017, at the Nairobi County with intent to deceive, he embossed a false stamp impression in the name of Nelson Pinto Atudo, advocate and commissioner for oaths.

The third count reads that on the same date he forged a signature on the self-declaration form in the name of Nelson Pinto Atudo contrary to section 345 as read with section 349 of the Penal Code.

On May 29, 2017, the MCA is accused of embossing a false stamp impression in the name Andrew Barney Khakula purporting to be a genuine stamp and forging a signature on the affidavit in the same name contrary to section 345 as read with section 349 of the Penal Code.

The court also heard that the MCA on February 23, 2017, embossed a false stamp and signature in the name of Samuel Ada Kandere Advocate and Commission, purporting them to be genuine, a fact he knew to be false.

On the last count, Oluoch is accused of knowingly and willfully making a false declaration under part 5 of the self-declaration form, set out in the first schedule of the Leadership and Integrity Act 2012, indicating he obtained a diploma from the Kenya Polytechnic on June 11, 1996.

Chief Principal Magistrate Isabella Barasa released Oluch on a cash bail of Ksh 100,000 or a bond of Ksh 3,000,000 and directed that he deposit his passport in court.

The matter will be mentioned on March 3, 2025.
