In Kenya, public officials who have been ousted by impeachment have been prevented from holding elected positions or being nominated in the national government and county.

Gachagua said that so far, he has not yet been declared a qualification for any position because his accountability is still being dealt with in the Supreme Court.

He suggested that his strategy was to advance the case in court without the intention of completing it immediately.

Gachagua gave an example of how the former president Uhuru Kenyatta And his deputy were elected in the 2013 General Election despite having criminal cases against humanity in the International Criminal Court (ICC) in the Netherlands.
