Battle for Gor Mahia! Sports Registrar rages over election delays

Gor Mahia faces a heated standoff as Sports Registrar Rose Wasike clashes with club officials over delayed elections and legal compliance.

Record FKF Premier League champions Gor Mahia are embroiled in yet another internal dispute this time over the delay in holding their long-overdue elections.

The feud, which has seen sharp exchanges between the club’s Secretary General Samuel Ochola and Sports Registrar Rose Wasike, continues to intensify as pressure mounts on the club to comply with the Sports Dispute Tribunal (SDT) ruling.

The origins of the conflict date back to July 17, 2024, when Wasike instructed Gor Mahia to organize elections following the expiry of the club’s executive committee’s four-year term on August 8, 2023.

The world marks the first anniversary of Kelvin Kiptum’s death on Tuesday but for his parents, it is a painful reminder of how unbearable life has been since their son passed away.

However, the process was delayed after club member Benard Agwera Omolo filed a legal petition at the SDT on September 1, 2024.

On January 15, 2025, the SDT issued a ruling ordering Gor Mahia to conduct elections within 90 days.

In response, Ochola wrote to Wasike on January 30, seeking legal clarification on three key areas, including a copy of the two constitutions in the possession of the registrar and potential areas of amendment.

However, Wasike, in a strongly-worded response on February 7, did not take kindly to Ochola’s request, accusing him of employing delay tactics to frustrate the election process.

“Even with the court order instructing you to hold elections within 90 days, you dare ask the Sports Registrar such flimsy questions?” she asked as per Mozzart Sport.

Wasike further expressed her disappointment that Gor Mahia Chairman Ambrose Rachier, a seasoned lawyer with over 40 years of experience and an Advocate of the High Court of Kenya, had not yet made the necessary constitutional amendments during his tenure.

“Your chairman and yourselves should be answering the raised questions; the Chairman being a lawyer like me and an Advocate of the High Court should be asked why he has never amended the constitution for all the years he has been in office,” she added in the letter addressed to Ochola.

The Sports Registrar emphasized that Gor Mahia must comply with the SDT ruling and immediately proceed with the election process. She instructed the club to issue notices to its members and relevant offices, ensuring elections are held within the stipulated time frame.

“Please stop delaying the elections, issue the necessary notices to members and relevant offices and proceed for election as advised by me and as per the SDT ruling that you referred to,” Wasike asserted.

Additionally, she made it clear that in cases where the club’s constitution conflicts with the provisions of Article 82 of the Constitution of Kenya 2010, the Sports Act, the Sports Registrar Regulations 2016, or any other relevant law, the legal provisions will take precedence.

The current Gor Mahia Executive Committee, which came into office on August 8, 2020, has continued to serve beyond its four-year term, which ended on August 8, 2023.

However, the SDT’s ruling on January 15, 2025, allowed the committee to remain in office temporarily to facilitate the upcoming elections and ensure continuity within the club’s administration.

Rachier, who has been at the helm of the 21-time Kenyan champions since 2008, might be in the final year of what could be an 18-year reign.

His prolonged stay in office has sparked debate among club members and fans, with some pushing for fresh leadership to steer the club forward.

The clock is ticking, and all eyes are on the club’s leadership to see if they will adhere to the 90-day deadline or face the wrath of the Sports Registrar and the relevant authorities.
