Speaking during a break in Naivasha, Ichung'wah wanted to know who was the complainant in the Mulei case.
He questioned whether the complaint came from Sha, the Ministry of Health, or if the police worked freely without being guided by Sha or the Ministry.

Ichung'wah added that systems sometimes fail, and he found nothing wrong with Mulei to raise concerns about the failure of the SHA system.
“Arresting a Kenyan who raises concerns about the SHA system error was unnecessary,” he added.
What did the Ministry of Health say about Ichung'wah's statement?
Responding to Ichung'wah's question, the Secretary -General of the State Department of Medical Services, Harry Kimtai, who came before the MPs, acknowledged that the Ministry of Health was the complainant in the Mulei case.
The parliamentarians, expressing the utter disgust at the Ministry of Health's move, expressed their displeasure and questioned the ministry's reasons for Mulei.
Speaker Moses Wetang'ula intervened when he saw that Kimtai was struggling to express his argument with parliamentary complaints.
As soon as the MPs calmed down and rested, Kimtai said that the Ministry of Health would remove its case against Mulei.
