Nairobi – The Supreme Court has found former Migori governor Okoth Obado and a case to respond to the murder of Sharon Otieno.
Which Judge made a decision about the murder of Sharon Otieno
In a decision on Thursday, January 30, Judge Cecilia Githua also found Obado Michael Oyamo and former Migori County employee Caspal Obiero to have a case to respond to the brutal murder of Sharon, a former Rongo University student.
In his ruling, Judge Cecilia said the evidence presented by the prosecution had initiated a preliminary case to allow the three to be defended.
However, the judge released the three on charges of killing a baby in Sharon's womb.
Judge Cecilia agreed with the arguments made by the defense in accordance with the Living Birth Code, which states that in order for a child to be a victim or anyone accused of murder, the child must be born alive.
“I have considered these presentations and I agree that the evidence presented by the prosecution to support baby Sharon does not support the murder charges,” He said.
Was Okoth Odado the father of the baby in Sharon's womb?
As previously reported, a state -owned father's investigation showed that the former Migori governor was the father of Sharon's baby who was killed.
The results of a DNA survey presented in the Supreme Court indicate the probability of 99.99+% that Obado gave birth to a baby.
Investigative analyst John Mungai, during Wednesday, July 14, separated Michael Oyamo, who is also accused of the murder of Sharon, as the father of the fetus.
What Okoth Obado's lawyers told the court
Obado, through his team of lawyers led by Kioko Kilukumi, struggled to convince the court that he had no support in Sharon's murder and that the government considered environmental evidence to involve him.
He hinted at the allegations that Sharon's real killers were still arrested for six years in the horrific killings.
Meanwhile, Obado's defense said that he was in an open relationship with Sharon; His teens at the county headquarters and his family knew about it.
The former governor had even expressed his intention to help the late baby who was in the womb despite susperating that he might have had sexual relationships with other men.
The lawyers added that their client offered to buy Sharon a house and merge money to take care of her, among other requirements, to prove her commitment to care for her and the unborn baby.
