On Wednesday, December 18, Judge Luck Mwamuye dismissed the Senate's request for the removal of the order to prevent the removal of the governor who is surrounded by controversy.
In his decision, the Judge extended the time of the order, suspending the dismissal of Mwangaza for 120 days.
The judge said that Mwangaza will continue to perform his duties until his petition against his removal from power is heard and decided.
“After analyzing the issues to be decided, it is my overall conclusion that the petitioner has met the legal threshold required for the issuance of a conservatorship order and for it to be confirmed and extended to the full hearing and determination of the petition herein.”
“In this judgment confirm and extend the temporary (conservative) orders for a period of 120 days from this date and time, the plaintiff will continue to serve as the governor of Meru county with the provision that the judgment in this case may be given before the completion of those days 120 on its date,” the judge ruled.
In reaching his decision, the Judge considered the public interest, saying that the reversal of the orders would cause the successor to the governorship in Meru to wait for the completion of the impeachment case and raised concerns about how the transition would be affected if Kawira wins the case.
Mwamuye warned that withdrawing the orders would create a leadership vacuum, which he claimed could cripple the county's operations.
This was the third time that Mwangaza was removed from power after another in the last two years.
He was saved by a Senate committee in 2022 when the first attempt to impeach him was carried out.
Another attempt to oust him came in November 2023, when he was saved in a General Assembly session.
