- The restructuring of the IEBC is now becoming another controversy, as parliament is being dragged once again
- Supreme Court Justice Isaac Lenaole blamed two parliaments for allegedly delaying the referral of the electoral management council in the country
- Senate Majority Leader Aaron Cheruiyot blamed the Judiciary which he accused of issuing a restraining order and thus obstructing the process.
Nairobi – Senate Majority Leader Aaron Cheruiyot has sought to rid parliament of allegations of deliberate planning on the restructuring of the Independent Electoral and Boundaries Commission (IEBC).
Supreme Court Justice Isaac Lenaola criticized the two parliaments for failing to speed up the reform process IEBCwhich currently has no quorum.
Lenaola criticized the lawmakers for wanting to enact other important political laws while turning a blind eye to the restructuring of the country's central election management board.
“I don't understand why we are working to pass other laws very quickly on other issues that are important politically, but we are not looking at what is very important for this country. The electoral commission, how can a country like ours stand on its feet if it does not have an electoral commission in 2027 , this is 2024. When will this commission be prepared?” asked Lenaola.
Isaac Lenaola is surprised by the strike of the digital court system in the case of Gachagua: “2027 je!”
In addition, he asked Kenyans to camp on social media to press for immediate action by relevant stakeholders.
“Why not use social media to influence social media. Why not have the hashtag #AppointIEBC and spread it? Those who have the opportunity will follow it and do something,” added Lenaola.
Accepting the blow on behalf of his colleagues, Cheruiyot said the parliament should not be blamed for the friction in the creation of the commission.
The Kericho senator repeatedly criticized the parliament for being dragged into the evils of other stakeholders in the leadership ranks.
According to him, the Judiciary is delaying the process through many restraining orders from the court.
“Parliament is the easiest scapegoat for all our social evils. I am surprised my friend Judge Lenaola would want to blame us for the IEBC crisis. As parliament, we passed an important law almost a year ago. It is the Court that has given stalled progress to court orders every time I could understand him Alas Sapit did not know this but he is not a member of the bench for sure,” complained Cheruiyot.
The IEBC Commission has been without commissioners for almost two years since the departure of the former chairman Wafula Chebukati and commissioners Molu Boya and Abdi Guliye, whose terms of service have ended.
Normally, the commission would continue to work if there was no resignation of the four commissioners who are; Juliana Cherera, Irene Masit, Francis Wanderi and Justus Nyang'aya.
The resignation of the quartet at the height of the conflict surrounding the 2022 presidential election denied the electoral body the ability to carry out its constitutional duties.
