The Court of Appeal in Nairobi has dismissed the appeal of the wing led by Kanini Kega which sought a temporary stay against the decision of Judge Janet Mulwa.

Lawyer Jackson Awele told TUKO.co.ke that the group, which includes Kanini, Joshua Kutunyand the National Disciplinary Committee of the Jubilee Party, had tried to suspend the implementation of the High Court's decision pending the outcome of their appeal.

However, on November 11, Justices Jamila Mohammed, Mumbi Ngugi, and Fred Ochieng rejected their request.

“The lawyers for the petitioners urged us to issue a temporary order to suspend the judgment of the High Court pending the decision of this application. In the context of this application, we refuse to issue temporary restraining orders pending the issuance of that decision.” said bench judge 3.

What is the decision of the Supreme Court regarding the leadership of the Jubilee Party?

The Supreme Court had previously approved the legal leadership of the Jubilee Party under its founder, the former president Uhuru Kenyatta.

The ruling party reinstated party chairman David Murathe, Treasurer Kagwe Gichohi, and General Secretary Jeremiah Kioni, returning control to Kenyatta's team.

Despite being pushed back, the appeal of the Kega wing is still alive, with the Court of Appeal planning to issue its decision on the case on March 7, 2025.

While this was happening, the Supreme Court had ordered seven Jubilee Party leaders who opposed Uhuru who rebelled against the party to leave their public or party positions.

The decision given by Judge Nduma Nderi, followed a petition submitted by a citizen through lawyer Awele in the Labor Court.

The petition claimed that the dual roles of the seven leaders, who held public positions and positions within the Jubilee Party's National Executive Committee (NEC), were unconstitutional.
