Kenya Newspapers, November 1: A Simple Mistake That Cost Gachagua In Dismissal Case

1. The Standard

Procedural mistakes made by the lawyers of the former deputy president (DP) Rigathi Gachagua cost his life in court in his impeachment case.

Former DP lawyers served the initial parties in the case and left those who later ordered the case.

Opposition lawyers used technical errors to force an adjournment until next week.

Initially, Gachagua named the attorney general, the Senate, the two speakers of August House, the President William RutoKenya Lawyers Association and Kithure Kindiki as respondents.

However, the three-judge bench that heard the case added the Independent Electoral and Boundaries Commission (IEBC) and the United Democratic Alliance (UDA) as new parties in the consolidated cases.

Lawyers representing UDA, including Adrian Kamotho, argued that they were not given court papers, while those representing IEBC noting that they were not added as respondents.

A three-judge court adjourned the case until next week, as it lifted a conservative order preventing the swearing-in of Kindiki as vice president.

Law professor Kithure Kindiki is about to become the second in the leadership of Kenya after the court removed the last obstacle in his way.

Supreme Court Justices Eric Ogola, Anthony Mrima, and Fred Mugambi said they had the authority to hear applications challenging the removal of Rigathi Gachagua.

The three noted that the 2010 Constitution did not envisage a situation in which the Office of the Deputy President will be vacant except in the short period required to fill it.

“Therefore, the public interest demands that the Office of the Deputy President should not remain vacant,” they said.

Kindiki will be the 13th senior presidential aide in Kenya's history.

They also proposed a permanent stipend based on 30 percent of the basic salary, saying that teaching while standing is stressful and tiring.

The teachers also wanted the science instructors to be paid a detoxification allowance of 20 percent of their basic salary due to exposure to harmful substances in the laboratory.

On Thursday, October 31, the police shot a suspect in the murder of the human resources manager of Wells Fargo Willis Ayieko.

Detectives tracked the suspect, whose name has not been released, to a guest house near Kisumu Polytechnic and shot him dead.

The police revealed that the deceased was one of two people who escaped after a shootout with officers in Gem.

The commander of the Nyanza region, Patrick Tito said they will continue with the search for all the suspects.

The female suspect in the killing died after being involved in a fight with the police during their arrest.
