The Employment and Labor Relations Court is now subpoenaing the employees in the office of the sacked Deputy President Rigathi Gachagua submit answers.
Judge Hellen Wasilwa said the 108 workers who were allegedly sent on compulsory leave should submit their contracts along with court papers.
According to the newspaper Business Daily, Wasilwa said that the agreements will help give direction to the case.
On October 20, 2024, the Administrative Secretary in the DP's office ordered the employees to take compulsory leave, saying it has no legal basis.
Why does the court want the contracts of Gachagua workers
The African Center for Peace and Human Rights filed a petition at the Employment and Labor Relations Court challenging the move, claiming it was illegal.
The petitioner claimed that the direction taken by the government showed that the workers were politically victimized.
Lawyer Lempaa Suiyanka noted that the employment contracts of civil servants do not depend on the administration or political leader they work for.
Judge Wasilwa also ordered the respondents, including the Public Service Commission (PSC) – which the petitioner claims was not consulted, the head of the public service and the attorney general to submit responses within seven days.
The case will be mentioned again on November 13, 2024.
Kuria claims all Gachagua workers are from Mathira
This comes following the disclosure of the government's chief economic adviser Moses Kuriawho are alleged to show Gachagua as unfair in his selection.
In a post shared on X on Friday, October 18, Kuria claimed that 80% of the staff in the Office of the Deputy President are from Mathira constituency.
However, Kuria failed to explain the reasons for this mass holiday which comes a few days after Gachagua was fired.
