Gachagua did not participate in the Senate on October 17 when he was expected to appear for questioning; his lawyers later informed parliament that he had been bitten and admitted to a hospital in Nairobi.

The Senate continued the impeachment process despite his absence.

53 senators voted in favor of Gachagua's dismissal, while 13 unsuccessfully tried to save him.

The ousted vice president immediately filed a petition challenging his impeachment, citing a violation of his right to a fair hearing.

High Courts of Nairobi and Kerugoya accepted Gachagua's request and issued conservative orders to block the process of replacing him.

The parliament requested that the conservative orders be removed because the arguments contained in them were unfounded.

With the suspension orders referring to the dismissal of charges, Gachagua through his lawyers filed another case asking three judges supported by Deputy Chief Justice Philomena Mwilu to hear the case.

Gachagua's lawyers, led by Senior Advocate General Paul Muite, argued that the deputy chief justice has no authority to preside over the bench, saying that the role is reserved for Chief Justice Martha Koome alone.

Judges Freda Mugambi, Anthony Murima and Eric Ogolla, dismissed the request and refused to recuse themselves from the case.

Therefore, the Gachagua team has moved to the court of appeal to challenge the decision of the previous judges regarding their resignation and the duty of the DCJ to appoint them to handle the case.

The case being brought to court has delayed the appointment of outgoing Internal Security Minister Kithure Kindiki, whom President William Ruto appointed on October 18 to replace Gachagua.
