Moses Kuria Hints Kithure Kindiki Will Only Be Sworn In Even If The Court Raises Objections

Where will Kindiki be sworn in?

Kuria joined the government officials in the field, to prepare the venue for the installation of Kindiki, and distributed parts and photos showing the progress of the preparations before the exercise.

The swearing-in ceremony will take place at Uhuru Gardens, Nairobi.

“Inspecting the swearing-in site tomorrow of HE Kithure Kundiki, the third deputy president under the Constitution of Kenya of 2010,” Kuria tweeted on Friday evening, October 18.

Kuria indicated that Kindiki's swearing-in will continue despite the Nairobi High Court's order to stop the process of filling the vacancy left by the deputy president following the dismissal of Rigathi Gachagua.

Judge Chacha Mwita, on Friday, October 18, suspended the process until the case filed by the contested Gachagua is heard and decided.

In his decision, Mwita said that the applications and oaths of support from Gachagua's lawyers are appropriate and thus he is satisfied with the court issuing the suspension order.

The judge ruled that the suspension orders will be in effect until October 24, when the case will be heard before a jury led by the Chief Justice. Martha Koome.

Judge Mwita emphasized the implementation of the order while warning that disobeying or not following the law will result in punishment for the parties who will be found responsible.

What did Gachagua request in court?

In his application submitted to the court, Gachagua, through his lawyers, criticized the decision of the Senate session stating that the impeachment took place without him, thus violating his right to a fair hearing.

The team of lawyers led by Paul Muite argued that the charges brought against Gachagua before the National Assembly and later confirmed by the Senate are baseless and lack sufficient evidence.

He said that the Senate, as a decision-making body, was required by law to act as an impartial arbiter in determining whether the allegations were substantiated.

Gachagua listed the Speaker of the National Assembly, the Speaker of the Senate, the Senate and the Attorney General as those who responded to the request.

The ousted DP's legal team also sought an injunction to prevent the National Assembly from vetting and approving Kindiki.

Muite explained that allowing the publication of the government gazette would be unfair to Gachagua, saying that doing so before the case is fully resolved would violate his constitutional rights.
