Why Rigathi Gachagua wanted the activities of the Senate to be suspended
Gachagua filed a case in the Supreme Court seeking a temporary order to stop discussions on the motion to oust him from government.
In his petition, Gachagua argued that the National Assembly has violated his constitutional rights and that only the court can save him from impeachment.

Gachagua said the resolution passed by the National Assembly is invalid for several reasons, and the motion to remove them is full of general and unsupported allegations.
On Tuesday, October 15, the presiding judge of the Milimani Court, Chacha Mwita, refused to issue the orders requested by the Gachagua legal team.
Judge Mwita said the courts have the authority to oversee decisions, including dismissal of charges, made by judicial bodies such as the National Assembly and the Senate.
In his decision, Judge Mwita refused to stop the impeachment case, saying that the Senate must be allowed to carry out its duties and the vice president can oppose the final decision of the senators.
