On Friday, September 20, Masengeli appeared before Judge Lawrence Mugambi in an effort to avoid a six-month prison sentence due to the disappearance of three Kenyans.

Judge Mugambi canceled the sentence of 6 months against the former Acting Inspector General after appearing in court personally.

Despite the opposition from the lawyers of the Bar Association Kenya (LSK), Judge Mugambi gave Masengeli a chance to defend himself.

In his decision, Mugambi said it was fair to give Masengeli a chance to explain himself, considering the court had ordered him to do so within seven days.

“Gilbert Masengeli can avoid imprisonment if he obeys the order to attend the summons of the court. Therefore, I suspend the imprisonment for 7 days only. He can escape by appearing before the court in person,” said Judge Mugambi.

“I will be going against my orders if I deny him the opportunity to be heard as demanded by LSK. This is a fair court and it should do justice to those who come before it. Gilbert Masengeli has the right to be heard in accordance with this order. I will let him stand in the dock and defend himself. You should be in the dock,” Judge Mugambi said.

Why did the court reject Masengeli's request before?

Masengeli's problems increased on Thursday, September 19, after the High Court rejected his attempt to apologize and delayed his sentencing.

At the hearing, Masengeli, through his lawyers Steve Ogolla and Cecil Miller, wanted to appear before Judge Mugambi to plead for pardon.

However, the court rejected the request, which was seen as an effort to avoid his six-month prison sentence. Masengeli had requested to be allowed to appear before the High Court Judge and present his pardon application between 6:00 pm and 9:00 pm.
