On Thursday, August 22, a case was filed at the Milimani Court challenging Joho's fitness to serve as Minister.

The Genesis Commission for Human Rights, in their petition, argues that Joho's appointment was unconstitutional.

Caleb Ngwena, a resident of Bamburi, Mombasa County, claims in a supporting affidavit that Joho is not fit to hold the position of Minister due to his involvement in dubious land deals in Mombasa County.

“That the respondents in purging the person who should be appointed as the Secretary of the Council of Ministers acted against the procedures and against the law as the respondents did not take into account the various Memoranda with evidence of their unworthiness to be appointed,” court document as quoted by Citizen Digital read in part.

The petitioner wants the court to prevent Joho from carrying out his duties as Minister of Mines, Economy and Maritime Affairs until the application is heard and decided.

“That pending the hearing and decision of this petition, the Court will be pleased to issue protective orders that prevent the Party from working and/or performing the duties and responsibilities of the Minister of Mines, Economy and Maritime Affairs and/or holding that position in any way, “ the prayer said.
